By accessing, browsing or using this Site, you agree to be bound by these terms of use conditions and any other terms, conditions, policies, notices and disclaimers on this page and elsewhere on the Site as amended from time to time (“Terms of Use”). Please read these Terms of Use carefully before using this Site. These Terms of Use are in addition to the specific Membership Terms and Conditions (which can be found at https://chiefmetachicks.com/terms-conditions ) that apply to the provision of the services offered by Chief Meta Chicks, as well as our Privacy Policy (which can be found at https://chiefmetachicks.com/privacy-policy/). If you do not agree to be bound by these Terms of Use, please immediately discontinue your use of the Site.

Chief Meta Chicks reserves the right to amend these Terms of Use from time to time without notice. Any amendment will be effective immediately upon being posted on this Site. Your continued use of this Site after any amendment becomes effective will constitute your agreement to be bound by these Terms of Use, as amended.

Chief Meta Chicks reserves the right to vary or modify the information contained on this Site, to change or discontinue any feature or part of this Site, to change the hours of availability and the equipment required to obtain access to this Site, without notice and without liability.

All Users of the Site

These Terms of Use apply to all users of the Site, including but not limited to customers, members, those who are viewing content and/or anyone who otherwise interacts with the Site in any way.

By using and/or visiting the Site, you affirm that you are either 18 years of age or older, or if you are aged under 18, that you have the consent of a parent or guardian to these Terms of Use. If you are under the age of 18 years old you agree that you will not create a User Account (defined below) or make any purchase using the Site.

Further to the above clause, you also affirm that in your State/Territory you are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Use, and to abide by and comply with these Terms of Use.

Conduct or forward surveys, contests, pyramid schemes or chain letters;
Download any file posted by another user that you know, or reasonably should know, cannot be legally distributed in such manner;
Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded;
Restrict or inhibit any other user from using and enjoying the Site;
Harvest or otherwise collect information about others, including e-mail addresses, without their consent;
Access the Site through any technology or means other than the pages of the Site itself or other explicitly authorised means we may designate;

We reserve the right to discontinue any aspect of the Site at any time by the provision of reasonable notice

Purchases Through the Site

Purchases made through the Site are subject to Chief Meta Chicks’ Membership Terms and Conditions (which can be found at https://chiefmetachicks.com/terms-conditions). In addition, any payments made to third parties directly will be subject to the terms of those providers.

Privacy

Chief Meta Chicks may collect, use, store, record and transmit your personal information entered on or made available to us via this Site. Your continued use of the Site and your provision of your personal information constitute your approval for Chief Meta Chicks to deal with your personal information.

User Account

You are required to create an account (“User Account”) before you can access certain parts of the Site or purchase a Membership (defined below). Your User Account must have a unique username and password and you must keep each of these confidential at all times and not allow any third party or unauthorised person to use your User Account at any time.

You must provide complete and accurate information when creating a User Account, and we may seek verification of the information provided by you at any time, subject to the Privacy Policy. You cannot use another person’s User Account (unless expressly authorised to do so by us) and must immediately notify us of any unauthorised use of your User Account. You agree that you will not transfer, lease or sell your User Account without our express approval.

You agree not to open or operate more than one (1) User Account unless expressly authorised by us. You must not activate or operate a User Account for anyone but yourself, unless expressly authorised to do so by us.

You agree that you will not use your User Account to transmit any material which is indecent, defamatory, menacing, offensive obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, hateful, discriminatory or objectionable material with respect to race, religion, origin or gender.

Subject at all times to law, we reserve the right to co-operate with any legal order or direction or any regulatory request to disclose the identity or other information relating to a user, where it is apparent that information has been provided to us which violates any law, or where we are otherwise legally compelled to make such a disclosure.

We retain the right and absolute discretion to terminate your User Account and/or access to the Site (or any element thereof) if we believe that you are abusing or tampering with the Site (or any element thereof) in any way, that you have provided false or misleading User Account information at any time, that you are in breach of these Terms of Use at any time, or that you have engaged in any unlawful conduct or other misconduct calculated to jeopardise the safety of other users, or the proper administration of the Site (or any element thereof). Our legal rights to recover damages or other compensation from such an offender are reserved.

Membership

We offer a range of paid memberships through our Site (“Membership” or collectively “Memberships”). By purchasing any Membership, you understand that you will be bound by our Membership Terms and Conditions. You understand that we reserve the right to update or change any or all of our Memberships at any time.

In order to purchase a Membership through the Site, you must submit certain information (“Member Information”). The Member Information may include, but is not limited to, your name, contact details and credit card details.

All Memberships are non-transferable, unless expressly authorised by us.

You hold Chief Meta Chicks harmless against and you must indemnify Chief Meta Chicks for any losses, costs, expenses or damages suffered or incurred if any of the Member Information provided by you is not correct.

Pricing and Payment

All prices displayed on the Site are in Australian dollars (AUD) and include GST, except where otherwise stated.

You acknowledge that all Memberships are subject to our pricing and other terms including in the Membership Terms and Conditions.

In addition to the Membership fees and charges (where applicable), you are responsible for all charges and fees associated with signing up for and using in connection to your Membership and accessing the Site, including without limitation Internet service provider fees, telephone, computer and printer equipment, sales taxes and any other fees and charges necessary to use or access your User Account, your Membership or the Site. In addition, you may incur an additional processing and/or merchant charge from your financial institution on each payment you make.

User Submissions and Enquiries

From time to time, you may be able to post, upload or provide information (such as employment opportunities) reviews and/or comments on or via the Site (“User Submissions”). You irrevocably grant to Chief Meta Chicks, its affiliates and sub-licensees a non-exclusive, royalty free, perpetual, worldwide, irrevocable and sub-licensable licence to use, reproduce, modify, adapt, publish, translate, create adaptations from, distribute and display such reviews and comments for any purpose in any media, without compensation, restriction on use, attribution or liability. You expressly consent to any use by Chief Meta Chicks of any User Submission which may otherwise infringe your moral rights pursuant to the Copyright Act 1968 (Cth) or in any other applicable jurisdiction and warrant that you have the full authority to grant these rights.

You agree not to post any User Submission that is unlawful or fraudulent, or that Chief Meta Chicks may deem threatening, derogatory, abusive, harassing, defamatory, obscene, offensive, inappropriate, false, misleading, objectionable with respect to race, religion, origin or gender, in breach of any intellectual property, privacy, publicity or other rights, or otherwise unsuitable for publication. If you do, you agree to indemnify Chief Meta Chicks for any losses, costs, expenses or damages that Chief Meta Chicks may suffer or incur as a result.

All User Submissions should be truthful and accurately reflect your experience and genuine opinions. Chief Meta Chicks reserves the right, but not the obligation, to review, edit or delete any User Submission that Chief Meta Chicks deems to be in breach of these Terms of Use. Chief Meta Chicks is under no obligation to post or use any User Submission you may provide and may remove any User Submission at any time in Chief Meta Chicks’ sole discretion.

By posting, uploading, inputting, providing or making your User Submission you warrant and represent that you own or otherwise control all of the rights to your User Submission as described in these Terms of Use including, without limitation, all the rights necessary for you to provide, post, upload, input or make the User Submission.

From time to time, you may also be able to make enquiries or requests via the Site. You warrant that you will not use this function on the Site for any purpose that is unlawful or prohibited by these Terms of Use or in any manner that could disable, overburden or impair the Site.

Disclaimer

Chief Meta Chicks does not warrant, guarantee or make any representation regarding the accuracy, adequacy, reliability, completeness or timeliness of the information available on this Site (“Information”) or that it is suitable for your intended use. The Information is provided by Chief Meta Chicks in good faith on an “as is” basis without warranty of any kind.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, to the maximum extent permitted by law, Chief Meta Chicks, its affiliates, partners, suppliers, licensors and licensees will in no way be liable to any party for any injury, loss or damage arising out of or related to the use of (or the inability to use) the Site.
